QUINTESSENTIALLY BESPOKE LTD's ("QUINTESSENTIALLY BESPOKE") website (our "Site") and related services are made available to you pursuant to the following Terms of Use & Service and any other rules posted on our Site (collectively, the "TOS"). Please read the TOS carefully before placing any order or utilising any service.
We may modify the TOS from time to time. Please read the TOS and check back often. Any changes made after you have placed an order will not affect that order however, unless we are required to make the change by law.
ELIGIBILITY TO PURCHASE
In order to make purchases, you will be requested to register and provide your personal details. In particular, Customers must provide their real name, phone number, e-mail address and other requested information as indicated. Furthermore, when ordering items or purchasing a service, you will be required to provide payment details and you represent and warrant that the payment details you provide on ordering are both valid and correct and you confirm that you are the person referred to in the Billing information provided.
The Site is available only to individuals and others who meet the QUINTESSENTIALLY BESPOKE terms of eligibility, who have been issued a valid credit card by a bank acceptable to QUINTESSENTIALLY BESPOKE, whose applications are acceptable to QUINTESSENTIALLY BESPOKE and who have authorised QUINTESSENTIALLY BESPOKE to process a charge or charges on their credit card in the amount of the total purchase price for the merchandise and/or services which they purchase. QUINTESSENTIALLY BESPOKE reserves the right to restrict multiple quantities of an item being shipped to any one customer or postal address.

Our products
When making his/her order the Customer shall be informed as to the availability of the Product he/she wishes to select.
For any queries regarding a Product’s unavailability, the customer may contact the Customer Service Department by phoning +44 (0)845 224 2617.
However, in the exceptional event of the Product being unavailable after confirmation of the order, the Customer shall be informed of the fact by email, no later than five (5) working days after confirmation of the order.
The photographs illustrating the Products presented reproduce them as faithfully as possible, but are of no contractual value. The Customer is advised to view the description of each Product to satisfy him/herself as to its basic characteristics.
All Products remain the property of Quintessentially Bespoke or its associates until payment is received in full.
PRICES
Prices are indicated in Pounds Sterling including VAT.
The Value Added Tax is the tax applicable on UK territory.
The prices charged are those displayed on the Website at the time of ordering.
QUINTESSENTIALLY BESPOKE makes every effort to ensure that the information provided on this website is accurate and current; however this web site and its contents is provided on an "as is" basis and make no (and expressly disclaim all) representations or warranties of any kind with respect to this website and its contents. QUINTESSENTIALLY BESPOKE reserves the right to change price and availability information without notice.
ACCEPTANCE OF YOUR ORDER – WEB AND TELEPHONE ORDERS
Once you have made your choice and your order has been placed, you will receive an email acknowledging the details of your order. This email is NOT an acceptance of your order, just a confirmation that we have received it.
Unless you cancel your order, acceptance of your order and completion of the contract between you and QUINTESSENTIALLY BESPOKE will be completed when we email you to confirm the goods have been dispatched. The sale contract is therefore concluded in London, England and the language of the contract is English.
We reserve the right not to accept your order in the event, for example, that we are unable to obtain authorisation for payment, that shipping restrictions apply to a particular item, that the item ordered is out of stock or does not satisfy our quality control standards and is withdrawn, or that you do not meet the eligibility criteria set out within the TOS.
PERSONAL SHOPPING AND SERVICES
QUINTESSENTIALLY BESPOKE goods can be previewed and purchased via a Quintessentially Bespoke representative in person. Any charges relating to this services , unless otherwise agreed, will be billed in accordance with Quintessentially Bespokes' pricing structure. Please also see Eligibility to Purchase.
Quintessentially Bespoke will act as a sales agent for third party products.
Quintessentially Bespoke may at your order purchase these goods (or services if applicable) on your behalf. In the event that it acts as a credit agent in this regard, you hereby authorise Quintessentially Bespoke to deduct the credit sum from your Payment Card within 30 days of the payment date. A 10% administration fee will be added to all purchases made on your behalf by QUINTESSENTIALLY BESPOKE.

Personal shopping is non refundable. If paying by the hour you accept the terms of the service and will be billed accordingly after the service has been provided. Payment will be taken by the Payment card provided by the customer. Please see Eligibility to purchase.
MADE TO ORDER
Orders can be placed online or with a Quintessentially Bespoke representative in person or by telephone. Any order placed verbally with a Quintessentially Bespoke representative for a ‘made to order’ product will be confirmed in writing. Confirmation of this agreement will be sent by email to you within 7 days. A 50% deposit is required on confirmation. The remaining 50% is payable on completion of the product. Work begins on your order as soon as it is placed therefore it is not possible to cancel or change your order after it has been confirmed. As each order is personally tailored, the full cost of the product is non refundable, non exchangeable and we cannot accept returns.
Our service includes all necessary adjustments which will be made in between your fitting and the final delivery. Should you choose to make further adjustments after you have received your final order, these will be your responsibility.
Quintessentially Bespoke acts as a ‘fixer’ service and undertakes to arrange and manage such orders on your behalf. Any fee chargeable for such a service will be agreed prior to any work carried out by QUINTESSENTIALLY BESPOKE.
PAYMENT
Only payments made by bank card (VISA, VISA ELECTRON, MASTERCARD, AMERICAN EXPRESS, DELTA AND MAESTRO) are accepted. Please note a 3% administration charge is incurred on AMERICAN EXPRESS transactions. Credit cards are always debited in UK pounds sterling. If you are a customer whose credit card is not denominated in Sterling, the final price will be calculated in accordance with the applicable exchange rate on the day your credit card company processes the transaction. All credit/debit card holders are subject to validation checks and authorisation by the card issuer. If the issuer of your payment card refuses to authorise payment to QUINTESSENTIALLY BESPOKE, we will not be liable for any delay or non-delivery.
Methods of payment such as bank transfers and cash on delivery are not accepted.
The amount of the invoice will be debited to the bank account at the date when the products are dispatched. In the event of partial delivery, only the value of the goods actually delivered will be debited.
The making of an order implies acceptance by the customer, thereby entailing formation of the contract and the customer’s final acceptance of the prices and descriptions of the products available for sale, as well as acceptance of the general conditions of sale as a whole.
We will take all reasonable care, in so far as it is in our power to do so, to keep the details of your order and payment secure, but in the absence of negligence on our part we cannot be held liable for any loss you may suffer if a third party procures unauthorised access to any data you provide when accessing or ordering from the Site.
INSURANCE AND DELIVERY
QUINTESSENTIALLY BESPOKE delivers anywhere in the world. QUINTESSENTIALLY BESPOKE insures each purchase during the time it is in transit until it is delivered to your specified delivery address. We require a signature for any goods delivered, at which point responsibility for your purchased goods passes to you. If you have specified a recipient who is not you for delivery purposes (for example as a gift) then you accept that evidence of a signature by them (or at that delivery address) is evidence of delivery and fulfillment by QUINTESSENTIALLY BESPOKE and transfer of responsibility in the same way.
Orders are dispatched following the successful processing of your bank and address details. This process which ensures your safety and ours against Credit Card fraud, can take up to 24hrs after you have placed your order, but we will send you an email immediately notifying you that your order has been shipped. For the customer security first-time orders can only be shipped to the cardholder's billing address or a corporate work address which QUINTESSENTIALLY BESPOKE are able to verify independently. Return customers can have the Products delivered to a different address from his/her own.
QUINTESSENTIALLY BESPOKE will make its best efforts to ensure delivery of the order, enclosing the evidencing invoice, within an average of four (4) to five (5) working days and a maximum of thirty (30) working days from the day following the date of payment of the order. It is hereby specified that orders placed on the QUINTESSENTIALLY BESPOKE website on Friday afternoon from 1.00pm onwards, Saturday or Sunday will be processed the following Monday. Orders placed on the QUINTESSENTIALLY BESPOKE website on public holidays will likewise be processed the next working day.
Delivery will not be made in the event of transport strike and/or postal strike.
The products shall be deliverable only subject to availability.
Deliveries within the UK shall be sent by ordinary delivery or express delivery (depending on the postage and packaging cost option selected by the customer). For the rest of the world, orders are dispatched by express delivery and the cost of the carriage depends on the number of items ordered.
QUINTESSENTIALLY BESPOKE cannot be held responsible for delays caused by external circumstances.
SHIPPING FEES
Orders outside the European Union and Monaco will not be charged VAT (15%). They are subject to local taxes upon arrival except for Switzerland and Norway. The Customer is responsible for any local taxes incurred. We recommend you contact your local customs authority to determine a landed cost price prior to purchase completion.
In case of incomplete delivery, shipping fees will only be charged on the first delivery.

Packaging options
If required, gifts will be packaged in our signature black patent gift boxes. These are stunning and can be kept and used again. This will incur an additional charge of 30GBP
RIGHT OF WITHDRAWAL
With respect to all distance selling transactions the customer shall have fourteen (14) working days from the date of receipt within which to return the articles he/she has ordered, at his/her own expense and without stating reasons. To be returnable, the products must be neither worn nor washed. The products must be returned in their original condition and packaging to the following address: QUINTESSENTIALLY BESPOKE, 10 Carlisle Street, London, W1D 3BR, UK.
If the above-stated conditions are fulfilled, QUINTESSENTIALLY BESPOKE shall refund the customer for the total amount of his/her order, within fifteen (15) days of QUINTESSENTIALLY BESPOKE receiving the Products, except for the cost of returning the Products, which shall be borne by the Purchaser.
EXCHANGES AND REFUNDS
The customer shall have fourteen (14) working days within which to return or exchange, at his/her own cost, any Product ordered by distance selling methods if it fails to give him/her satisfaction. This time limit shall run from the date of receipt of the Products. Beyond that time limit, QUINTESSENTIALLY BESPOKE may at its option refuse to make the exchange or refund.

The RMA number must be indicated on the outside of the returned package. Unidentified returns may be returned to the sender.
All Products must be returned in their original condition and packaging, neither worn nor washed, to the following address: QUINTESSENTIALLY BESPOKE, 10 Carlisle Street, London, W1D 3BR, UK, enclosing the initial invoice, on the back of which must be stated the reasons for the return.
It shall be the customers responsibility to retain all proof of return; this implies returning his/her order by registered parcel or by any other means of ascertaining the date of the return dispatch.
Any products returned other than in their original condition and packaging, particularly where they are incomplete, or have been work or dirtied by the customer, will not be taken back. In the event of abnormal or unreasonable returns, QUINTESSENTIALLY BESPOKE may refuse to honour any future order.
If the above-stated conditions are fulfilled, QUINTESSENTIALLY BESPOKE shall refund the customer for the total amount of his/her order, within fifteen (15) days of QUINTESSENTIALLY BESPOKE receiving the Products, except for the cost of returning the Products, which shall be borne by the customer.
In the event of an exchange, QUINTESSENTIALLY BESPOKE will not charge the customer for the cost it incurs in re-sending the product exchanged.
If your order has been sent to a destination within the EU, all VAT will be refunded. Outside the EU, customs duties and sales taxes are non-refundable through QUINTESSENTIALLY BESPOKE. However, you may be able to recover these by contacting your local customs bureau directly. Exchanges made to destinations outside of the EU will be submitted to the same customs procedures, therefore applicable for duty and tax again.
LATE RETURNS
Please seek to return items within 14 days of the date of your RMA request. Returns outside these timeframes may be accepted at the discretion of QUINTESSENTIALLY BESPOKE, and depending on the circumstances may only be refunded as a store credit. Please note that RMA numbers requested after 7 days will also be granted at our discretion.
YOUR RIGHTS
You have certain rights under the law. These include, in England:
1. That any products you order through this Site will be of satisfactory quality, fit for their intended purpose, and will conform to any description given on this Site;
2. Certain remedies if a product is defective; and
3. A right to cancel any order for a product within seven working days commencing on the day after the date on which you receive it, and receive a full refund even if it is not defective.
Nothing in the TOS is intended to affect these rights. For more information about your rights contact your local Citizens Advice Bureau or Trading Standards Bureau.
LIMITS ON OUR LIABILITY
We accept liability for death and personal injury arising from our negligence or that of our employees and agents. We do not seek to exclude our liability for fraudulent misrepresentation by us or our employees or agents.
Nothing in the TOS is intended to affect your rights under the law (see "Your Rights" above).
If QUINTESSENTIALLY BESPOKE breaches the TOS we shall only be liable for losses which are direct losses and a reasonably foreseeable consequence of such a breach. Losses are foreseeable where, for example, they could be contemplated by you and QUINTESSENTIALLY BESPOKE at the time of you placing your order, and QUINTESSENTIALLY BESPOKE dispatching your order. We shall only be liable for losses up to 150% of the total value of goods purchased.
We are not responsible for losses not caused by our breach or negligence, indirect losses which are a side effect of the main loss or damage and which are not reasonably foreseeable by you and us (for example, loss of profits or loss of opportunity).
We are also not responsible for failure to meet any of our obligations under the TOS where such failure is due to events which beyond our reasonable control.

We may include hyperlinks on this Site to other websites or resources operated by parties other than QUINTESSENTIALLY BESPOKE, including advertisers. QUINTESSENTIALLY BESPOKE has not reviewed all of the sites linked to its Web Site and is not responsible for the content or accuracy of any off-site pages nor are we responsible for the availability of such external websites or resources, and do not endorse and are not responsible or liable, directly or indirectly, for the privacy practices or the content of such websites, including (without limitation) any advertising, products or other materials or services on or available from such websites or resources, nor for any damage, loss or offence caused or alleged to be caused by, or in connection with, the use of or reliance on any such content, goods or services available on such external websites or resources.
GOVERNING LAW
The TOS together with all our policies and procedures will be governed by and construed in accordance the relevant United Kingdom law and the relevant courts of the United Kingdom will have exclusive jurisdiction.
PRIVACY POLICY
We will treat all your personal details as confidential and we will only disclose this information in the circumstances set out below. We will keep it on a secure server and we will comply with UK Data Protection legislation in relation to the use of your personal data. When you register on this Website, or make a purchase we will ask you to input and will collect personal details from you such as your name, e-mail address, billing address, telephone number. We may also collect, and our third party providers may collect, information about where you are on the internet (e.g. the URL you came from, IP address, domain types like .co.uk and .com), your browser type, the country and telephone area code where your computer is located, the pages of our website that were viewed during your visit, any advertisements you may have clicked on, and any search terms that you entered on our Website.
We use your information only for the following purposes:
a. maintaining your registration
b. for statistical purposes to improve this Website and its services to you
